1. Who Provides the Services

These Terms and Conditions ("Terms") govern the use of the Qaxufa platform and the purchase of language courses, lessons, and related digital content offered through it. By accessing the website or placing an order, the user ("Customer" or "User") agrees to be bound by these Terms, which are drafted in accordance with the Polish Civil Code (Kodeks cywilny), the Act of 30 May 2014 on Consumer Rights (Ustawa o prawach konsumenta), and other applicable Polish and European Union law.

2. How an Order Is Placed and Confirmed

To purchase access to a course, subscription plan, or individual lesson package, the User selects the desired product on the website, provides the required information (including a valid email address), and completes the payment process. An order is considered submitted once the User confirms it on the checkout page.

Qaxufa confirms receipt of the order by sending a confirmation message to the email address provided by the User. The contract for the provision of Services is concluded at the moment this confirmation is sent, unless Qaxufa notifies the User that the order cannot be processed, in which case any payment already made will be refunded without undue delay.

The User is responsible for ensuring that the information provided during the order process is accurate and complete. Qaxufa reserves the right to refuse or cancel an order in cases of suspected fraud, technical error, or violation of these Terms.

3. Prices, Payment and What Is Included

All prices displayed on the website are stated in the currency indicated at checkout and include applicable value-added tax (VAT) where required by Polish law, unless explicitly stated otherwise.

Payment is processed through the payment methods offered at checkout at the time of purchase. Access to the purchased course, subscription, or lesson package is granted upon successful confirmation of payment.

Unless otherwise specified in the product description, the price includes access to the purchased learning materials, scheduled lessons or course modules, and any support services explicitly described as included on the product page. It does not include the User's own internet connection, hardware, software, or any third-party services not expressly listed as part of the offer.

Qaxufa reserves the right to change prices for future orders at any time. Changes in price do not affect orders already confirmed.

4. Cancellation and Complaints

4.1 Right of Withdrawal

Consumers who conclude a contract with Qaxufa remotely have the right to withdraw from the contract within 14 calendar days from the date of concluding the contract, without giving any reason, in accordance with the Act on Consumer Rights. To exercise this right, the User must send a clear statement of withdrawal to [email protected].

If the User expressly requests that performance of the Services (e.g. immediate access to digital learning content) begin before the end of the withdrawal period, and fully consents to this, the right of withdrawal may be lost once the Service has been fully performed, in accordance with applicable Polish law.

4.2 Complaints

Any complaint regarding the quality, availability, or content of the Services should be submitted by email to [email protected], including a description of the issue and, where applicable, order details. Complaints will be reviewed and answered within 14 days of receipt, in line with Polish consumer protection standards.

5. Limitation of Liability

Qaxufa makes reasonable efforts to ensure that the Services are available, accurate, and of good quality. However, Qaxufa does not guarantee uninterrupted or error-free access to the platform and shall not be liable for temporary unavailability caused by technical issues, maintenance, or circumstances beyond its reasonable control.

To the extent permitted by Polish law, Qaxufa's liability for damages arising from the use of the Services is limited to the amount paid by the User for the specific Service giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded or limited under mandatory provisions of Polish law, including liability for intentional harm.

6. Cookies and Consent

The website uses a single cookie, named consent_mode, which stores the User's cookie consent choice for a period of one year. No analytics, tracking, or session-management cookies are used on this website.

Advertising measurement is activated only after the User has given consent, and only on the order confirmation page.

7. Governing Law and Jurisdiction

These Terms are governed by Polish law. Any disputes arising from these Terms or the use of the Services shall be submitted to the competent Polish courts, without prejudice to any mandatory consumer protection rights available under EU law.

Consumers residing in Poland may also refer disputes to the President of the Office of Competition and Consumer Protection (Prezes Urzędu Ochrony Konkurencji i Konsumentów, UOKiK) or use out-of-court dispute resolution mechanisms available under Polish law.
